Reservation of rights for text and data mining and AI training

Images exported using Engelmann Software and protected with AI training protection carry a machine-readable reservation of rights. The creator or rights holder of the image has thereby declared that the image may not be used for text and data mining, nor for training, fine-tuning, or operating AI models.

The rights holder is the person who created the image. Engelmann Software only provides the tool used to set this reservation.

Legal basis

  • § 44b Para. 3 of the German Copyright Act (UrhG) and Art. 4 Para. 3 of Directive (EU) 2019/790: A machine-readable reservation of rights excludes text and data mining for commercial purposes.
  • Art. 53 Para. 1 lit. c of the AI Act (EU) 2024/1689: Providers of general-purpose AI models must respect such reservations.

How the reservation is stored in the image

  • TDMRep (W3C): tdm:reservation = 1, tdm:policy refers to this page
  • IPTC / PLUS: plus:DataMining = DMI-PROHIBITED-AIMLTRAINING
  • XMP Rights: xmpRights:Marked = True with terms of use
  • C2PA Content Credentials: Assertion cawg.training-mining with ai_training, ai_generative_training, ai_inference, and data_mining all set to notAllowed, cryptographically signed

The C2PA signature proves that the reservation has not been altered after export.

Verifying the reservation

Upload the image to a C2PA validator, e.g., contentcredentials.org/verify. The entries will appear there under “Training and Data Mining.”

Note: The publisher “Engelmann Software GmbH” is displayed there as “not on the trust list” because we operate our own certification authority. The signature is nevertheless valid and can be verified with our root certificate:
