  1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed through our online shop by consumers or businesses.

A consumer is any natural person entering into a legal transaction for private purposes.
A business is a natural or legal person acting in the exercise of their commercial or self-employed professional activity when concluding a contract.

  1. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By submitting an order, you make a binding offer to conclude a purchase agreement.
Acceptance takes place through confirmation by e-mail or by delivery of the goods or digital product.

  1. Prices and Payment Terms

All prices include applicable statutory VAT.

Payment is made using the payment methods offered in the shop.

  1. Delivery and Provision

    Physical Products

Delivery is made to the address specified by the customer.
Orders are generally processed within 3 business days.

Digital Products

Digital content (e.g. software, license keys) is usually provided immediately after payment has been received.

Orders placed through external platforms may occasionally experience delays.

  1. Retention of Title

The goods remain our property until full payment has been made.

  1. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.
Details can be found in our separate cancellation policy.

  1. Special Conditions for Digital Products

For digital content (e.g. software, downloads, license keys), the following applies:

The right of withdrawal may expire prematurely if

  • the customer expressly agrees that we begin contract performance before the withdrawal period expires, and
  • confirms that they lose their right of withdrawal as a result.

This generally occurs upon delivery of the download or license key.

The customer receives a simple, non-transferable right to use the software in accordance with the applicable license terms.

  1. Returns and Refunds

Our separate return and refund policy applies.

  1. Warranty

The statutory warranty rights apply.

  1. Liability

We are liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health.

In cases of ordinary negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations).
In such cases, liability is limited to the foreseeable damage typical for the contract.

Any further liability is excluded.

  1. Use of the Website

It is prohibited to use the website for unlawful purposes or to cause technical disruptions (e.g. through malware).

  1. Amendments to the Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time with effect for the future.

  1. Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.

  1. Place of Jurisdiction

If the customer is a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction is Dortmund.

  1. Final Provisions

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
